Heard learned Counsel for the Petitioners and learned AGP for the State.

The challenge in these petitions is to an order passed by the Industrial Court at Thane on 29 February 2000. The order merely directs the Petitioner State to prepare a seniority list of the complainants as per procedure laid down in Clause 4(d) of the Industrial Employment (Model Standing Orders) Act, 1946 and as when permanent posts are created or permanent vacancies arise due to retirement, etc., regular employment would be given to the complainants in these posts, if they are found suitable and fulfiling the necessary requirements. The order, in other words, effectively permits the Petitioner State to verify suitability as well as fulfilment of criteria for appointments in the State. The order, such as this, does not warrant any interference.

Accordingly, Rule is discharged in all these petitions and the petitions are dismissed. No order as to costs. (S.C. GUPTE, J.) 2 / 2
