This is an application for recalling the order dated 22.11.2011 after condoning delay of 1 year 192 days., thereby, restoring Second Appeal.

Mr. Ghadigaonkar states that all the respondents are duly served except respondent no.8. Respondent no.8 is deleted as per Court's order dated 16.8.2011 passed in Civil Application

2/2 CAS/894/2013 No.307 of 2009.

For the reasons stated in the application which are not controverted, Civil Application is allowed in terms of pray clauses (a),(b), and (c) with no order as to costs. Second Appeal is restored to the file of this Court.
