The above Writ Petition is filed seeking the writ of mandamus to the Chief Metropolitan Magistrate [CMM], Mumbai to expeditiously adjudicate and dispose of Securitization Application No. 427 of 2021 filed by the Petitioner herein under Section 14 of the SARFAESI Act, 2002. 2.

The learned Advocate appearing for the Petitioner submitted that during the pendency of the above Petition, the learned CMM has already passed an order dated 19th June, 2023 under Section 14 of of the SARFAESI JANUARY 15 2024 Laxmi

5 wp 338-24.doc Act, 2002. She, therefore, submitted that nothing survives in the above Writ Petition and sought leave to withdraw the same. 3.

In these circumstances, the above Writ Petition is dismissed as withdrawn. No order as to costs.
