The grievance in the Public Interest Litigation is to the lack of adequate number of benches under the Sick Industrial Companies (Special Provision) Act, 1985 resulting in years taken to dispose of the references made by sick companies for being declared sick and rehabilitation scheme sanctioned. SICA has been repealed. Issues of winding up or rehabilitation are now being dealt with before the National Company Law Tribunal.
