The learned counsel for the applicant fairly submits that in the present case, charge is framed against the accused. The trial has commenced. On 28.9.2016 itself summons were issued to the complainant for recording of evidence and it appears that in all probability, the evidence of the complainant/any other witness is recorded by now.
