Learned counsel for the applicant submits that during the pendency of this application investigation is completed and charge sheet is filed. Hence, he seeks liberty to withdraw the application with liberty to approach the Sessions Court in the changed circumstances. Liberty as prayed for is granted under Section 439 of the Cr. P .C. in the interest of justice. It is made clear that the learned Sessions Judge shall decide the application on its own merits without being influenced by the withdrawal of this application.
