DATE: 20th JUNE, 2018 P.C.:- 1] By way of present application, Applicant is seeking permission to travel abroad as per itinerary given by him in para 40 of the application.

2] Perusal of record reveals that, on earlier occasions, Applicant was granted such liberty on number of occasions. Last such order has been passed on 16th March, 2018 by Division Bench of this Court in Criminal Application No.385 of 2018.

3] In that view of the matter, we are inclined to allow the 1/2

Applicant, however, as has been directed in the earlier order, shall file an undertaking to the effect that the applicant shall make himself available in the event the criminal appeal is taken up prior to the date of his return and if disposed of he shall abide by all the consequences in law.

4] Application is therefore allowed in terms of prayer clause (a), subject to the undertaking to be filed by the Applicant within a period of one week to the effect that the applicant shall make himself available in the event the criminal appeal is taken up prior to the date of his return and if disposed of he shall abide by all the consequences in law.

5] The Application is disposed of.
