Heard learned counsel for the parties.

By this Application, the Applicant seeks pre-arrest bail in connection with C. R. No. I-88 of 2019 registered with the Vishnunagar Police Station, District - Thane, for the alleged offence punishable under Sections 324, 504, 506(2) r/w 34 of the Indian Penal Code.

According to the prosecution, the incident took place on 30.04.2019 at 9.45 a. m. It is alleged that the accused -
Makrand Shirsat, Jagannath Sawant, Sikandar Nandyal and the Applicant came in a car and abused the Complainant - Suraj Pawar, on account of some previous enmity. According to the prosecution, the accused assaulted the Complainant with fist blows. It is further alleged that co-accused - Jagannath assaulted the Complainant on his head with a beer bottle and co-accused - Sikandar assaulted the Complainant on his head with a chopper. According to the prosecution, the Applicant is alleged to have assaulted the Complainant with fist blows. The Applicant has attended the concerned police station, as directed by this Court vide order dated 11.06.2019.

Considering the role of the Applicant, the Application is allowed and the Applicant is granted pre-arrest bail on the following terms & conditions :-
O R D E R
(i) In the event of arrest, the Applicant be enlarged on bail, on executing P. R. Bond in the sum of Rs. 20,000/- with one or two sureties in the like amount;
(ii) The Applicant shall report to the investigating officer of the
concerned police station as & when called for by the investigating officer;
(iii) The Applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case;
(iv) The Applicant shall inform his latest place of residence and mobile contact number immediately and/or change of residence or mobile details, if any, from time to time to the Court seized of the matter and to the Investigating Officer of the concerned Police Station; (v) The Applicant to cooperate with the investigation. 5.
The Application is allowed in the aforesaid terms and is accordingly disposed of.
