The learned counsel for the applicant seeks relaxation of the amount of P.R.Bond, which he was directed to submit alongwith one or more surety/sureties in the like amount, as a condition for releasing him on bail in an offence where he faces accusations under Sections 302 read with Section 34 of the I.P.C.

Heard the learned counsel for the applicant and perused the application.

2/2 67 APPLN-226-22.doc The applicant was directed to be released on bail by the Hon'ble Supreme Court vide it's order dated 25/02/2022 and the Sessions Judge, Borivali Division was directed to stipulate the terms and conditions of his release. Accordingly, on 10/05/2022, he was directed to be released on bail by the Additional Sessions Judge, Mumbai, on executing P.R.Bond of Rs.50,000/- with one or more surety/sureties of the like amount.

The applicant states that he is in dire fnancial crisis and he was a driver by profession and is unable to arrange for the aforesaid amount. This is the precise reason that though the order was passed on 10/05/2022, still he is languishing in jail. 4.

Considering the request made in the application and showing magnanimity, the amount of P.R.Bond is slashed to Rs.25,000/-. Resultantly, the applicant shall be released on bail on executing P.R.Bond of Rs.25,000/- with one or more surety/sureties in the like amount.

With the aforesaid modifcation in the order dated 10/05/2022, the application is allowed.
