At the outset, learned counsel for the petitioner presses for only prayer clause (a) and not the other prayer clauses i.e prayer clauses (b) and (c). Prayer clause (a) reads thus : "(a) To issue a Writ of Mandamus or a Writ in the nature of Mandamus, or any other appropriate Writ or order or direction under Article 226 of the Constitution of India, to SQ Pathan 1/2

3-WP-2393-2023.doc the Respondents, ordering and directing the Respondents to register an FIR of the Petitioner No.1 to 3, against the said Accused Builder / Directors / Managers." Learned A.P.P, on instructions, states that even prior to the filing of the aforesaid petition, FIR was registered in connection with the grievance raised by the petitioner and that the petitioner's statement has been recorded as a witness in the said case.

Learned counsel for the petitioner does not dispute the same.

Learned A.P.P further submits that investigation is complete and charge-sheet will be filed before the Competent Court in the first week of February 2024. Statement accepted. In view of the aforesaid, nothing survives for further consideration in the petition. Petition stands disposed of. MANJUSHA DESHPANDE, J.
