This Court has on 17th October 2016 directed the legal aid to be given to the petitioner. It appears that there is no compliance with the said order till date.

The learned APP submits that from letter sent by prisoner it appears that he was seeking transfer from Taloja Central Prison to Arthur Road Prison. She points out that this letter was written prior to May 2015. In this situation, we do not wish to dwell on merit of the request. Request if pending even today needs to be dealt with as per law. If it is already decided, order needs to be communicated to prisoner. We therefore direct the respondent - State to look into the said request and to take suitable decision upon it if it is not already taken.

pmw 2/2 appln-382.15.doc Decision on request to transfer to Arthur Road Prison shall be taken/ communicated within eight weeks from today. With these directions and keeping all the contentions of the prisoner open, we dispose of the petition.
