This Civil Application is moved for restoration of First Appeal, which was dismissed on 15th January, 2016 for non-filing of private paper book within stipulated time. 2.

The learned Counsel for the applicant makes a statement that the applicant will file private paper book on or before 10th January, 2020 as directed by this Court (Coram: K.K.Tated, J.) in Trupti 1/2

The learned Counsel for the respondent opposes the said Application.

In view of above statement made by the learned Counsel for the applicant, which is accepted, delay of 160 days in filing the Civil Application stands condoned and the order dated 15th January, 2016 stands recalled. First Appeal is restored to its original file.
