This is the second attempt of the Applicant to obtain anticipatory bail from this Court. On the earlier occasion the Applicant had filed Anticipatory Bail Application No.677 of 2020. That application was rejected by a reasoned order on Digitally signed by Pradeepkumar P. Deshmane Date:

2020.12.19 13:31:49 +0530 merits after hearing of the parties. Now this is the second Pradeepkumar P. Deshmane attempt made by the same Applicant on the ground that one Nesarikar

2 / 2 06-ABA-976-20.odt Hotel Fidalgo is owned by Maberest Hotels Pvt. Ltd. of which the Applicant is one of the directors is being sold to M/s Golden Peace Hospitality Pvt. Ltd. for Rs.70 Crores and he seeks anticipatory bail on this ground.

The earlier order was passed on 23/10/2020. The Applicant was not protected by any order since then. Even prior to that he was not protected by any order and he was absconding. It is quite surprising that though he was not protected, he could enter into business transaction. In any case, MPID is sufficiently strong and empowers the authorities to attach properties of the accused and recover investors' money. The Applicant is still absconding. I am not inclined to interfere with my earlier order. Therefore the present application is rejected.
