The petitioner only presses for prayer clause (C), which reads thus :
"C) That investigation of Complaints/ representations of Petitioner against false FIR No. 367 of 2008 dated 27.6.2008 lodged by the Respondent No. 3 which needs to be conducted and so matter be transferred to Central Bureau of Investigation or any other Independent Agency." SQ Pathan 1/2
8-WP-1368-2021.doc Learned A.P.P states that the police, after investigation in C.R. No. 367/2008 have filed a `B' Summary report in the Court having jurisdiction.
Considering that a `B' Summary report has been filed in C.R. No. 367/2008 lodged by respondent No. 3 as against the petitioner, nothing survives for further consideration in the petition. Petition stands disposed of accordingly. At this stage, learned counsel for the petitioner makes a grievance against the police officers that they registered a false case as against the petitioner.
Needless to state that it is open for the petitioner to challenge the order passed by the police complaint's authority, before the appropriate forum.
