This is an application under Section 439 of Code of Criminal Procedure for bail.

The applicant came to be arrested in Crime No.1095 of 2021 registered at Chakan police station, District Pimpri-Chincwad for the ofences punishable under Sections 302, 363, 364, 143, 144, 147, 148 & 149 of the Indian Penal Code (IPC). 3.

I have heard the learned counsel for the applicant, the learned APP for the respondent - State.

I have perused the charge-sheet. It appears that the deceased used to stalk the sister of the present applicant. On the day of incident which took place on 6 September 2021, the sister of the applicant disclosed to him that at about 11.30 a.m., while she was on the way to market, the deceased misbehaved with her. 2/2 906-ba-2065-22.doc According to the prosecution, at about 1.00 p.m., the present applicant and other co-accused assaulted the deceased by iron rod and stone. Considering the facts and circumstances of the case, I am inclined to release the applicant on bail. In the result, the following order is passed.

O R D E R

A] Bail Application is allowed.

B] The applicant be released on bail in C.R. No.1095 of 2021 registered at Chakan police station, District PimpriChincwad for the ofences punishable under Sections 302, 363, 364, 143, 144, 147, 148, 149 & 212 of the IPC on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
