By this petition, the petitioner seeks quashing of the FIR, registered vide C.R. No. 60 of 2022, with the CBD Belapur Police Station, Navi Mumbai, for the alleged offences punishable under Sections 506(2) and 417 of the Indian Penal Code read with Section 30 of the Indian Arms Act.

Learned APP submits that the Police after investigation, have filed an 'A Summary Report' in the Magistrate Court on 16th July,

bipin prithiani 909-wp-2749.22.doc 2022. Learned APP has tendered the said report dated 28th November, 2022, of P. I. Umesh Gavali, CBD Police Station, Navi Mumbai. The said report is taken on record.

In view of the said report, nothing survives for further consideration in the petition. Petition stands disposed of accordingly. The petitioner is granted liberty to file a fresh application/petition, if the occasion so arises. We make it clear, that we have not heard the petition on merits. 4.

The learned Magistrate to decide the 'A Summary Report' filed by the Police, as expeditiously as possible and in any event, within three months from the date of receipt of this order. 5.
