Heard learned counsel for the Petitioner. Learned AGP waives service on behalf of Respondents Nos. 1 to 3. 2.

We do not intend to consider the challenge raised in this Petition at this stage. The Petitioner has an effective mechanism under the provisions of law to get his grievance redressed. The Petitioner in fact has approached the Civil Court seeking similar reliefs. Even the impugned orders dated 25th January 2023 passed by Respondent No 2 records that the Petitioner can approach the 2nd May 2024

32-ASWP-8328-2023.DOC Chief Comptroller Unauthorised Construction ("CCUC"), CBD Belapur, Navi Mumbai in respect of the grievance raised. 3.

In this view of the matter, considering that there exists an alternative, efficacious and effective mechanism for the redressal of the Petitioner's grievance before the CCUC, the present Petition is disposed of.
