Heard learned counsel for applicant and Learned APP. for State. Investigating ofÏcer is present with case diary. Learned counsel for applicant makes a statement that applicant has complied with order dated 13.3.2019 by attending Investigating ofÏcer which statement is accepted by learned APP on instructions. Applicant is protected by interim order of this court observing that except for being an employee of the ofÏce of Abhinav Kranti Organization she had not played any effective role in the present crime and as an employee has only carried - Page-1/2
Nalawade 4-aba1179-18.doc out her duty on the instructions of original accused Nos. 1 and 2 who are proprietors of the said organization and had floated some scheme to exchange old tractor against new on payment of some amount valued on the basis of old tractor, in which informant though had participated and gave his old tractor and some amount, however tractor was not delivered to him and thus lodged report. 2.
Considering limited role as aforesaid of applicant and since she has also made herself available for investigation merely because two accused persons are absconding, can be no ground to reject the application, as five other co accused are already released on bail. In the circumstances, application is allowed by confirming earlier order by imposing suitable condition as per order below.
ORDER
a) Interim order dated 19.6.2018 stands confirmed with directions to applicant to attend Investigating ofÏcer if called between 10.00 a.m. to 12.00 noon till filing of charge sheet.
