This is an application received from an under trial prisoner for expeditious disposal of Special Case No.8 of 2013 under section 307 r/w. 34 of the IPC and Special Case No.50 of 2013 under sections 307, 353, 143, 147 of the IPC and sections 3, 25 and 27 of the Arms Act. Both the cases are pending before Alibaug Sessions Court. 2.
The learned APP, under instructions submits that in Special Case No.8 of 2013 charge was framed and that total 53 witnesses are scheduled to be examined. The learned APP further submits that in Special Case No.50 of 2013, the trial has already commenced, five witnesses are already examined. Considering the fact that the Applicant accused is in custody since 2012, in my considered view, it is Megha 1/2
2_appln_390_2015 necessary to dispose of both the cases as expeditiously as possible. Hence, Special Judge, Alibag, is directed to make every possible endeavour to dispose of both these cases as early as possible and in any event within a period of one year from the date of receipt of this order. 3.
The application is disposed of accordingly.
