The Application is moved for relaxation of condition in the order dated 30th December, 2014 pertaining to attendance. At the time of granting pre-arrest bail to the applicant/accused, this Court has directed the applicant to report to Shivaji Nagar Police Station, Pune between 10 a.m. to 3 p.m. on 1st and 3rd Monday of each month. 2.

The learned counsel for the applicant/accused has submitted that the applicant/accused has attended the police station nearly for three years and hence he prays for relaxation of condition of attendance.

Learned APP has opposed this Application and submitted that till today the police has not filed the charge sheet, as report of Chemical Analyzer is awaited.

I am surprised to know that nearly for more than 2 years in the offences punishable under section 295(A) of the Indian Penal Code and under section 66A of the Information Technology Act, charge sheet is not filed on the ground that report of the Chemical Analyzer is awaited. Hence, the condition of attending the police station is hereby relaxed.
