This is an application under Section 439 of Code of Criminal Procedure for bail.

The learned counsel for the applicant submits that the bail application of the co-accused is pending before the Hon'ble Supreme Court. It is submitted that the applicant be permitted to withdraw the present application with liberty to fle fresh application for bail in case the Hon'ble Supreme Court releases the co-accused on bail.

Leave granted. The Bail Application is disposed of as withdrawn with liberty as sought for.
