First appeal came to be dismissed pursuant to an order of the learned Registrar (Judicial-II) of this Court as despite granting four weeks time for removing office objections, the same could not be removed. The order was passed by the learned Registrar (Judicial-II) on 22nd October, 2019.

Heard Mr. Thorat, the learned Counsel for the applicant. It is submitted that at the time of filing the appeal, cousin of the learned Counsel for the appellant was suffering from stomach Shailaja S.

11-IA-ST-98315-2020.doc cancer and was undergoing chemotherapy and other treatment at P.D. Hinduja Hospital, Mahim. Subsequently, his condition deteriorated and he has succumbed to the ailment. Thereafter, during lock down, it was noticed by the learned Counsel for the appellant while checking status of the first appeal online from the Website of this Court that the first appeal was dismissed. 3.
The reason assigned for non removal of the office objections seems to be just and proper. Hence, the order passed by the learned Registrar (Judicial - II) of this Court on 22nd October, 2019 is set aside and the appeal is restored to its original file by condoning the delay which has occurred in filing the application. 4.
The application stands disposed of in terms of the aforesaid observations and the first appeal is restored to its original file. 5.
