He states that during the pendency of this present application, charge sheet has been filed and that he would like to file an application in the Sessions Court after filing of the charge sheet. Accordingly, the Application is disposed of as withdrawn with liberty to file an appropriate

BA 1266-15.doc application in the Sessions Court. It is made clear that this Court has not considered the application on merits. If an application is filed, after filing of charge sheet, the learned Sessions Judge shall consider the application on its own merits, uninfluenced by the withdrawal of the application.
