Mr. Mundargi, learned Senior Counsel appearing for the petitioners states that on the last occasion the order impugned in this petition dated 2 nd June, 2017 passed by the Adhoc District Judge - 1,Raigad, Alibag by which hearing of the Revision Application No. 59 of 2017 was adjourned for the reason that respondent no. 3 was not served as on the date of the order. Today Mr. Mundargi states that respondent no. 3 has since appeared and the immediate reason for filing this petition would not survive. However, he on instructions seeks liberty to approach this Court in respect of prayer clauses (a) and (b). 2.

In the circumstances, he seeks to withdraw this petition. Petition is allowed to be withdrawn with liberty as aforesaid.
