This Writ Petition takes an exception to the fact that despite the Respondents herein filing Appeal No. 85 of 2007 challenging the eviction decree passed in favour of the Petitioner landlord dated 16th October, 2006, the said appeal is still not decided and the Respondents are sitting on an ad-interim order that was granted in their favour as far back as on 12th February, 2007.

Considering that this appeal has been pending for 10 years, this Writ Petition can be conveniently disposed of by Pg 1 of 2

13.wpl.17511.2017.doc directing the Appellate Bench of the Small Causes Court at Mumbai to hear and decide Appeal No.85 of 2007 as expeditiously as possible and in any event within a period of three months from today.
