3. Pending application, if any, stand disposed of." Thereafter, in view of the note placed before the Hon'ble the Chief Justice, the letter of the respondent Lata Vyas was placed before this Court.

Thereafter, on 4th December, 2023, the following order was passed;

01-FA-2031-2006.doc "1. Registry has placed a Note before the Hon'ble the Chief Justice on 27th September 2023 by drawing attention of the Hon'ble the Chief Justice towards a letter dated 6th September 2023 addressed by one Lata Vyas - respondent in the First Appeal.

2. On 8th September 2023, the appeal was dismissed by this Court pursuant to the submission made by the learned Counsel for the appellant that on the instructions of the appellant he seeks to withdraw the appeal. The appeal was dismissed as withdrawn.

3. Today, respondent - Lata Vyas is absent.

4. Mr. Talreja appears through Video Conferencing. His junior Mr. Mantri is physically present in the Court.

5. Mr. Talreja seeks an adjournment to appear physically before the Court.

6. At his request, list on 8th December 2023. First on Board."

Mr. Talreja, learned Counsel for the appellant submits that he has no objection if the respondent withdraw the entire amount. Statement is accepted.

The respondent- Lata Vyas is again absent today. Hence, no further orders.
