The learned counsel appearing on behalf of the Respondent No.5 Shri Vishal Kanade on instructions states that only symbolic possession of the property in question being Flat Nos.502 and 503, "C" Wing, Divyashrushti CHS, Gaurav Garden, Bundar Pakhadi Road, Kandivali (West), Mumbai- 400 067 would be taken. Statement accepted. In view of the aforesaid statement, it is not necessary to grant any relief in the above Civil Application. The aforesaid statement of the learned counsel appearing on behalf of the Respondent No.5 is without prejudice to the rights and contentions of the parties. The above Civil Application to accordingly stand disposed of in terms of the aforesaid statement.
