Considering the nature of directions proposed to be issued, notice on respondent no.2 is dispensed with. 2.

The grievance of the petitioner which is an Association registered under the provisions of the Societies Registration Act, 1860 as well as the Maharashtra Public Trusts Act, 1950 is to the registration granted by the 1st respondent to the 2nd respondent-Society on 18th January 2020. The petitioner is aggrieved by the grant of such registration and has thus sought to challenge the same in the present proceedings.

We find from the records that the petitioner has not made a request to the 1st respondent to cancel the registration as granted to the 2nd respondent. In these facts, therefore, the following directions would served the interest of justice :- (i) The petitioner is at liberty to move an application seeking cancellation/withdrawal of the registration granted to the 2nd respondent.

(ii) If such application is made within a period of 15 days from today, respondent no.1 shall consider the same in accordance with law and after giving an opportunity to respondent no.2. (iii) The decision thereof be taken expeditiously and preferably within a period of eight weeks of receiving such application. (iv) All points on merit are kept open for being considered by respondent no.1.

The writ petition is disposed of in aforesaid terms. No order as to costs.
