The applicant's first bail application was rejected on 12th February 2020 on merits; however, was granted liberty to renew his request for enlargement on bail if the trial does not commence on or before November 2020. Pursuant to liberty, the applicant has applied for the bail. 3.
Prosecution case, is that on 8th November 2018, coaccused Satyawan, dealt a blow of knife on the abdomen of MP 1/4
Haresh and with the same knife applicant dealt blow on the spinal region. Corresponding injuries were found and noted in the injury certificate of Jupiter Hospital where Haresh was treated. Applicant was arrested on 8th November 2018 and has been incarcerated since then. Yet charge has not been framed. The trial is not likely to commence in near future. It is informed that there are not criminal antecedents against the applicant. Applicant is permanent resident of Mumbai and thus his presence for the trial can be secured by imposing suitable conditions. In consideration of the facts, in view a case is made out for granting him bail. Hence, the following order.
ORDER
(a) The Applicant-accused in Crime No.
472 of 2018 registered with Mulund Police Station, Mumbai, is directed to be released on bail on furnishing P.R bond in the sum of Rs.25,000/- with one or more sureties in the like sum;

(b) The Applicant shall report to the Investigating OfÏcer of the concerned Police Station twice a month i.e.
First and Second Monday of each month between 11:00 a.m. to 01:00 p.m. till the charge is framed.
(c) The Applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.
(d) The Applicant shall furnish his permanent residential address and contact number to the Investigating OfÏcer forthwith within a week of his release from jail.

The application is accordingly allowed and disposed of.

It is made clear that, observations made herein above, shall be construed as expression of opinion for the purpose MP 3/4
of granting bail only and the same shall not, in any way, influence the trial in other proceedings.
