The Assistant Commissioner of Police, Wagle Estate Division and another .. Respondents Mrs. Veena Thadani, for the Petitioner.

Mrs. V. S. Nimbalkar, AGP for the Respondent Nos.1 & 2. CORAM : R.M. SAVANT, J.

DATE : 08th JULY, 2015 P.C.

1.

The above Writ Petition takes exception to the order dated 04.07.2015 passed by the Licensing Authority i.e. Assistant Commissioner of Police, Wagle Estate Division, Thane, by which order the Petitioner's Eating House Registration Certificate and Public Entertainment Licence to serve liquor has been suspended for a period of 15 days between 04.07.2015 to 18.07.2015. The order itself is dated 04.07.2015 which is received by the Petitioner on the same day. The order is to take effect immediately. The Petitioner has filed an Appeal on 06.07.2015 before the State Government i.e. Principal Secretary (Appeals and Security), Government of Maharashtra. In my view, it would be just and proper to BGP.

WP-6392-15.doc 08.07.2015 direct the Appellate Authority to hear and decide the Appeal within a particular time frame. The Learned AGP Mrs. V. S. Nimbalkar submits that time till 30.09.2015 be granted to decide the Appeal. The Appellate Authority is therefore directed to hear and decide the Appeal latest by 30.09.2015. Till the decision is rendered in the Appeal, the impugned order to stand stayed. With the aforesaid directions, the Writ Petition is disposed of.
