The Applicant herein has sought to condone the delay of two years and 99 days in filing the Appeal.

Heard learned Counsel for the Applicant and the learned APP for the State. I have perused the records. The Applicant herein has been convicted for the offences under Section 366, 376(2)(1) (n) and 376(D) of the Indian Penal Code. The maximum sentence imposed is of 20 years. The Applicant has stated that he is a native of Uttar Pradesh and hence he was unable to file the appeal.
