The Applicant had earlier preferred Interim Application No.4152/2022 in Criminal Appeal No.1104/2022 for his release on bail during pendency of the appeal. By a reasoned order dated 8.2.2023 the bail application pending appeal was rejected. This is the second time, the Applicant has preferred this application for bail. Deshmane(PS)

Learned counsel for the Applicant does not press this bail application. His request is that the Appeal be decided at the earliest.

Since the roster is not with this Court, it would be appropriate for the Applicant to make an application before the Bench having roster of final hearing of Criminal Appeals. The Applicant is given a liberty to make an application for fixing the Criminal Appeal for final hearing. In that application, the Applicant can raise the ground that sentence is for five years and since his conviction in October, 2022 he is taken in custody. That would be a valid ground for fixing the Criminal Asppeal for final hearing. 4.

With these observations, the present Interim Application is allowed to be withdrawn and is disposed of as such.
