Heard. This is an application under Section 438 of Cr.P.C. The applicant herein is apprehending his arrest in Crime No.30 of 2015 registered at Bombay Central Railway Police Station for the offences punishable under Sections 353, 420, 506, 120B of Indian Penal Code 2.

After argument for some time, the learned counsel for the applicant seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice. The learned counsel submits that the applicant would surrender before the concerned Magistrate on 10.8.2015.

In view of this, the applicant stand protected till 5 p.m. of 10th August, 2015. The learned Magistrate shall consider the application filed by the applicant under Section 437 of Cr.P.C. without being influenced by the withdrawal of this application and the application filed by the applicant be decided on its own merits.
