The learned counsel for the applicant submitted that the respondent no.1 is duly served by speed post and the applicant has filed an affidavit of service in that behalf. 2) The respondent no.1 is absent though duly served. 3) For the reasons stated in the application and in the interest of justice, the application is allowed in terms of prayer clause (a).
