Having heard the learned Counsel for the parties, we find that the impugned order is apealable, and the petitioner has already availed the said remedy. The appeal is pending before the Cooperative Appellate Court. In that view of the matter, we are not inclined to interfere with the petition and the same is accordingly dismissed.
