The application is filed for bail. Both the sides are heard. 2.

Along with the application, there is a copy of the FIR. A querry was made to the learned A.P.P. by this court to ask about the nature of the injuries sustained. He submitted that simple injuries are sustained by the complainant. 3.

The allegations made in the FIR show that the present applicant had some dispute with Shrikant who was a pillion rider on the motor cycle of the complainant. When quarrel started, the complainant took the present applicant and Shrikant towards winery. The allegation is made that in the campus of winery, the present applicant gave blow of sword which hit on the hand of the first informant and one Datta also gave blow of sword to the complainant. The material collected apparently does not show that there was intention to murder the first informant. There is no dispute with informant and he was only trying to intervene in the quarrel. The applicant is behind bars since 6th May,2017. In view of the nature of

kvm 2/2 4-BA1451.17 material available against him, this court holds that it is not desirable to keep him behind bars till disposal of the case which may be filed against him. In the result, the application is allowed. The applicant is to be released on bail on his furnishing P.B. and S.B. of Rs.15,000/- (Rupees Fifteen Thousand Only) with one surety of the like amount. The applicant is not to tamper with prosecution witnesses. He is not to commit similar offences.
