Learned Counsel for the applicant states that the applicant is ready to deposit the cheque amount of Rs. 5 lakhs. He submits that out of the said amount of Rs. 5 lakhs, the applicant has already deposited Rs. 1,20,000/- in the Court of the learned Metropolitan Magistrate. He submits that the applicant is ready to deposit the balance amount of Rs. 3,80,000/- without prejudice to his rights and contentions in this Court in 3 equal instalments. He submits that the first instalment of Rs. 1,25,000/- will be deposited by the applicant on or before 25th August, SQ Pathan 1/2
appr.374.16.33.doc 2016; the second instalment of Rs. 1,25,000/- will be deposited on or before 25th September, 2016; and the third instalment of Rs. 1,30,000/- will be deposited on or before 25th October, 2016. He has tendered a handwritten undertaking of the applicant, which is signed by the applicant. The said undertaking is taken on record and marked `X' for identification. 2.
In view of the undertaking given by the applicant, the applicant's sentence is suspended and the applicant is enlarged on bail on the following terms and conditions :
ORDER
(i) The applicant be enlarged on bail, on executing PR Bond in the sum of Rs. 10,000/- with one or two sureties in the like amount; (ii) It is made clear that the applicant shall deposit the said amount of Rs. 3,80,000/- in this Court as stated above. 3.
Application is accordingly disposed of.
