Heard. At the threshold, the learned APP submits that in the present case i.e. in Sessions Case No.70 of 2015, the prosecution has examined two witnesses. In view of this, the application deserves to be disposed of as this Court is not inclined to consider an application under Section 439 of Cr.P.C. after the trial has commenced. Hence, the application stands dismissed.
