The Learned APP draws our attention to the letter dated 17-7-2017 of by Shri N. S. Jadhav, Assistant Commissioner of Police, Tardeo Police Station, Division Mumbai addressed to the Petitioner. By the said letter the Petitioner has been informed that the allegations of the Petitioner were looked into and that during the course of the inquiry no evidence has come forward to sustain the said allegations. It is however stated in the said letter that departmental action has been taken against the constable concerned and that appropriate action has been recommended against him. In view of the said letter and especially the first part thereof namely that no evidence has come forward supporting the allegations of the Petitioner as a result of which the police have refused to register the FIR, we do not deem it appropriate to keep the above Petition pending. wp-2493-17(908) has been received by the Petitioner as can be seen from the endorsement of the Petitioner appearing on the said letter as having received it on 17-7-2017 at 7.30 p.m. which is at the left of the said letter. It would be open for the Petitioner to take appropriate recourse if so advised. The above Petition to accordingly stand disposed of.
