Learned counsel appearing for the appellant states that he has instructions to withdraw this appeal on the ground that both the parties have arrived at amicable settlement out of Court and proposes to file the consent terms before the Executing Court. The statement is accepted.

The second appeal is allowed to be withdrawn for the reasons stated aforesaid. A copy of the proposed consent terms is placed on record. It is made clear that the consent terms can be filed by the parties before the Executing Court.
