This Appeal is preferred by the husband challenging the Judgment and Order of dismissal of his Petition seeking divorce the wife also has filed cross-objection in the said Appeal.

Learned Advocate for the Appellant/husband produces on record the Judgment and Order passed by the learned District Judge-5, Kalyan in Marriage Petition No.149 of 2023 thereby divorce is granted by mutual consent by Order dated 14th February, 2024, wherein all the disputes between the parties have been settled. Today parties are also present in the Court.

In view of the same, learned Advocate for the Appellant seeks to withdraw the Appeal on instructions. This Court finds that in view of settlement, on the cross-objection have became infructuous. Both the proceedings stand disposed off as infructuous. 4.

The copy of the Judgment and Order dated 14th February, 2024 passed by the learned District Judge-5, Kalyan in Marriage Petition No.149 of 2023 is taken on record and marked as 'X' for identification. 5.

Appeal and cross-objection stand disposed off. 6.
