Inasmuch as it is an admitted position that no reasons are set out by the Vice Chancellor, Shivaji University, Kolhapur for changing the preference in favour of the Respondent No.5, learned Counsel for the parties are agreed to the following order being passed:

ORDER

i) The impugned order dated 13 August 2001 of the Tribunal as well as the order dated 15 November 1999 of the Vice Chancellor as regards change of preference is set aside to the extent of the post relating to the appointment for subject of Botany.

ii) The Vice Chancellor shall hear the Petitioner as well as the Respondent No.5 and decide the issue of change of

iii) The Petitioner and the Respondent No.5 shall appear before the Vice Chancellor on 22 March 2017 at 11 a.m. when appropriate directions may be given.

iv) All contentions are kept open.

v) The Writ Petition is disposed of in the aforesaid terms. (A.A.Sayed, J.) katkam
