By this petition filed under Article 226 of the Constitution of India, the petitioner seeks direction against the petitioner to invite the petitioner for registering the name of the petitioner for the counselling process for CLAT 2021 examination or in the alternate to consider the candidature of the petitioner for the other remaining round in admission process for CLAT 2020-2021 2.

By an order dated 12th August, 2021, this Court had recorded the statement made by the learned counsel for the petitioner that the petitioner had met with an accident. As a result of the same, his mobile got damaged and was unable to utilize the 1/3

cellular services. Mobile of the petitioner started on 30th July, 2021 and during those period of five days, the petitioner could not get any access to the email. The petitioner became aware that the counselling session was held on 28th July, 2021 as he received the SMS on 30th July, 2021. This Court had thereafter noticed that the schedule of counselling and that the 3rd and 4th list of successful candidates were to be published on 13th and 17th August, 2021 respectfully. The 5th and final list would be published on 28th August, 2021.

Learned counsel for the petitioner had also referred to the email dated 7th August, 2021 from CLAT Support Team informing that registrations for the counselling process for the year 2021 is closed. If at all more students have to be called for counselling, then the petitioner may be called. There was no guarantee of the petitioner being called. It would depend on how many seats get filled at the end of the counselling. This Court accordingly directed the respondent to reserve one seat in the National Law University, Bangalore till next date.

Today when the matter was called out, learned counsel for the respondent on instruction makes a statement that the application of the petitioner will be considered after the 5th and final round list is over on 28th August, 2021 in case of any vacancies are 2/3

available in compliance with the communication dated 28th July, 2021. The application of the petitioner shall be decided on its own merits by the respondent. Statement is accepted. In view of this statement, we are not going into the correctness of the averments by the petitioner in the writ petition and the statements made across the bar. All the contentions of both the parties are kept open. Interim order dated 12th August, 2021 stands vacated.

The writ petition is accordingly disposed of in aforesaid therms. There shall be no order to costs.
