This is an application for condonation of delay of five years and 42 days in preferring an application for leave to file appeal against the Judgment and Order dated 17.03.2011 in C.C. No.407/SS/2009 passed by the Metropolitan Magistrate, 20th Court, Mazgaon, Mumbai. 2.

Heard learned counsel for the applicant. Perused the record. 3.

Perusal of the record would clearly indicate that, no justifiable cause has been put forward by the applicant, nor proper explanation has been given for condonation of such an inordinate and colossal delay on the part of the applicant who is a corporate entity and in the field of banking. It further appears that except putting blame on the retired officers and/or on the Advocate who appeared before the Trial Court, no justifiable explanation has been given for delay. 4.

In view of the above, no case is made out for condonation of delay.

The application is accordingly rejected.
