IN THE HIGH COURT OF JUDICATURE AT BOMBAY CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO. 2289 OF 2016 Sanjeeva Rao.

..Petitioner.

Versus

State of Maharashtra & Others.

..Respondents.

Mr. Suresh Dubey for the Petitioner.

Mrs. A. S. Pai, APP for the State.

Coram : Ranjit More & A. M. Badar, JJ.

Date : April 25, 2017.

P. C. :

1.

Heard learned Counsel appearing for the Petitioner and learned APP for the State. Petition is filed seeking direction to the Respondents to register an FIR on the basis of Petitioner's complaint dated 26th June 2016 annexed at Exhibit-B to the petition. Learned APP, on instructions, makes a statement that preliminary enquiry into the allegations made by the Petitioner is already made and conclusion is arrived at that the dispute raised is of civil nature and that conclusion is already communicated to the Petitioner. Statement is accepted.

2.

In the light of above, we are not inclined to entertain this writ petition especially when the Petitioner has alternate remedy of approaching to Magistrate for redressing his grievance by way of private complaint. In that view of the matter, writ petition is dismissed.
