By this writ petition, the petitioner seeks a direction to the respondents to reserve the post of President of Trimbak Nagar Parishad for the members of the scheduled castes.
In the elections to the Nagar Parishad, that were held in the year 2012, the petitioner had contested on a seat reserved for the scheduled castes. The petitioner was elected. Initially, the President was elected from the open ism
2 61.8065.14 wp category and according to the petitioner, by rotation, though the post was liable to be earmarked for the scheduled castes, the same was not reserved for the scheduled castes. In the aforesaid background, the petitioner had sought the reservation of the post of the President of Nagar Parishad from the scheduled castes category.
The term of the office of the members of the Nagar Parishad as per Maharashtra Municipal Councils Nagar Panchayats and Industrial Townships Act, 1965 is 5 years and if the petitioner was elected in the year 2012, the term of office of the petitioner must expire in the year 2017. The writ petition was filed in the year 2014. Due to passage of time, the cause for filing the writ petition appears to have been rendered infructuous.
