1] Learned Senior Counsel appearing for applicant submits that during the pendency of this application, the investigation is completed and charge sheet is filed. Hence, he seeks leave to withdraw this application with further liberty to approach the sessions court under section 439 of Cr.P.C. in the changed circumstances.

2] It is made clear that this application has not been heard on merits. The learned Sessions Court shall consider the

YBG 24-ba-1468-18 application on its own merits and on the basis of charge sheet. 3] The learned APP at this stage, has submitted that the wife of the present applicant has also filed an application under section 438 of Cr.P.C. before the sessions court at Solapur. The said application also be heard on its own merits without being influenced by the withdrawal of this application.
