For the reasons separately recorded, the judgment and order dated 18/10/2010 delivered by Extra Joint Ad Hoc Additional Sessions Judge, C.R. No. 2, Sweree, Mumbai in Sessions Case No. 51 of 2009 is quashed and set aside.

The appellants are given benefit of doubt and are acquitted of the offences charged.

The respondent State to set them at liberty if their custody is not required by it in any other matter.

Muddemal property be dealt with as directed by the trial court after the appeal period is over.
