Mr. Kulkarni, the learned Counsel appearing for the CIDCO placed on record two allotment letters of even date issued by the Marketing Manager-I, CIDCO and addressed to the Petitioner. By these letters, the Petitioner is being offered plot bearing No. 61F, Sector-14, Koparkhairane, admeasuring 99.99 sq. mtrs., on the terms and conditions specified in the said letters. The letters are taken on record and marked "X" for identification. In terms of these letters, the learned Counsel appearing for CIDCO submitted that the Petitioner would be allotted alternate plot bearing No. 61F in lieu of plot No.61B. Statement is accepted.

In the light of above, learned Counsel appearing for the Petitioner states that grievance of the Petitioner no more survives. 3.
In the light of above allotment letters and statement made by the learned Counsel for the CIDCO, the CIDCO is directed to execute the deed of modification in terms of the allotment letters, as expeditiously as possible and at any rate within the period of two weeks from today. After execution of deed of modification, possession of the plot be given to the Petitioner at the earliest possible. 4.
