According to the learned Counsel for the Petitioner, the valuation of the Shopping Complex building situated at CTS No. 496/27/1, Sahakar Mandir, Ajinkya Colony, Sadar Bazar, Satara as reflected in the valuation report dated 29.04.2015 (page 82 of the Petition) is more than Rs.16 Crores.

We record the statement of learned Counsel for Respondent No.4Bank that Respondent No.4-Bank shall first recover outstanding dues of the Petitioner by auctioning the Shopping Complex building (which according to learned Counsel for the Respondent-Bank is to the tune of Rs.4.5 Crores.) and only if there is any deficit after the Shopping Complex building is sold, 1/2

In view of the aforesaid statement made by the learned Counsel for the Respondent-Bank, learned Counsel for the Petitioner does not press the Petition.

Subject to the above, the Writ Petition is disposed of. No costs. 5.

It would be open for the Petitioner to bring a purchaser of the said Shopping Complex building and negotiate with the Respondent-Bank to clear the outstanding dues by private treaty. [K. K.
